Under South Dakota Law, can a prior simple assault be removed from your record if you have had no like offense

I was charged with simple assault with my now ex-husband, in which it should have been dropped to disorderly conduct, but my then lawyer told me to plead guilty instead. Now I am trying to get a job in a clinic ( I'm an RN) and this charge is affecting whether I get the job or not. I am not a violent person and this charge is nothing but the result of a terrible fight between my then husband and myself, all due to another woman. Can it be removed? I have never before had any trouble with the law and I haven't since.

You can probably have the matter expunged (sealed and erased from your record). Hire an attorney licensed to practice law in the state of South Dakota, and (s)he can probably get the conviction expunged. Look for an attorney with experience doing expungements, and ask about their fees. I practice law in Minnesota, and my firm currently charges $550. We are not licensed in SD.I hope this helps, good luck to you.
